Making a Will
We’ll talk you through your options and draft a will suited to your circumstances. If you’ve lost a loved one who named you as executor, we can help establish where the will is held and confirm your position as executor. If you’re a beneficiary who believes a will may not be valid, we can advise whether you have grounds to challenge it. A free initial consultation is available to talk through any of this.
Powers of Attorney
A Power of Attorney lets someone you trust make decisions on your behalf, whether that’s because you’re temporarily unable to, or you no longer wish to manage things yourself. We’d strongly recommend having one in place, so you decide in advance who looks after your affairs if you’re hospitalised or later diagnosed with a condition such as dementia.
There are two types:
General Power of Attorney Covers your financial affairs and is valid only while you have mental capacity. Useful for a temporary period, such as a hospital stay or an extended time away, or if you’re finding it hard to get out and about. It can be revoked at any time, and it stops applying automatically if you lose mental capacity.
Enduring Power of Attorney Covers property, financial affairs and health decisions, and can be registered for use if you lose mental capacity or choose to hand over decisions sooner. It can’t be registered without your knowledge, you’re able to object if you feel it isn’t needed, and you can restrict it so it only takes effect if you lose capacity.
